Business Transfers
In the event of a merger, acquisition, or sale of all or part of our assets, personal data held by us may be transferred to the buyer or other relevant third party.
Legal Obligations
We may disclose personal data if required to do so by law or where we believe disclosure is necessary to protect our rights or comply with a judicial proceeding, court order, or legal process.
We do not sell or rent your personal data to third parties.
8. SMS/Text Messaging and Mobile Consent Data
Where SMS or text messaging features are enabled as part of the Services, we may collect and process mobile phone numbers, SMS message content, message metadata, delivery status, consent or request records, opt-out and help requests, and related information necessary to provide and manage text messaging services. This may include the date, time, method, and source of the interaction, the business or Customer associated with the interaction, and records of SMS keyword requests such as STOP or HELP.
We use SMS/Text Messaging Data to provide transactional and customer-care communications requested by or relevant to End Users, including responding to inquiries, helping with bookings or reservations, confirming or changing bookings or reservations, processing cancellations, sending operational updates related to the End User’s request, providing support, and managing SMS help or opt-out requests.
End Users may receive SMS messages when they initiate a text message conversation with us or with a business using our SMS/text messaging features. By initiating a text message conversation, the End User allows us and/or the applicable business to respond by SMS in connection with that conversation, request, booking, reservation, or support interaction.
SMS messages are intended only for transactional and customer-care purposes related to the End User’s request, conversation, booking, reservation, or support interaction with us and/or the applicable business using our Services. We do not use SMS/Text Messaging Data to send marketing or promotional text messages.
Message frequency varies depending on the End User’s interactions with us and/or the applicable business using our Services, and may include multiple messages per booking, reservation, support request, or conversation. Message and data rates may apply.
End Users may stop receiving SMS messages from the applicable messaging program by replying STOP. After an End User replies STOP, we and/or the applicable business may be unable to continue the SMS conversation unless the End User initiates or opts back into SMS communication again. End Users may request assistance by replying HELP or by contacting us at privacy@heysadie.ai.
No mobile information sharing for marketing purposes: We do not sell or rent mobile phone numbers, SMS message content, SMS opt-in data, or SMS consent. We do not share or transfer mobile phone numbers, SMS opt-in data, or SMS consent to third parties, affiliates, or lead generators for marketing or promotional purposes.
We may share SMS/Text Messaging Data with service providers, telecommunications providers, hosting providers, security providers, and other vendors only as necessary to deliver, operate, maintain, secure, and improve the Services; provide SMS messaging functionality; comply with law; prevent fraud or misuse; enforce agreements; or protect the rights, privacy, safety, or property of us, Customers, End Users, or others. Where we process SMS/Text Messaging Data on behalf of a Customer, we do so to provide the Services and in accordance with our agreement with that Customer.
Where SMS/text messaging features are provided through our Services or a Customer’s business, responses are generated by an artificial intelligence system and may be incomplete, inaccurate, or not reflective of the most current information available. End Users should not rely on SMS responses as a sole or authoritative source of information and should verify time-sensitive or important details, such as reservation availability, pricing, or operating hours, directly with the applicable business. We are not responsible for any loss or damage arising from reliance on AI-generated SMS content where the End User has been given an opportunity to verify such information.
9. International Data Transfers
We may transfer personal data to countries outside the European Economic Area (“EEA”) that may not have the same level of data protection laws. Where we do so, we ensure there is an appropriate level of protection. For example, we may implement Standard Contractual Clauses approved by the European Commission, or rely on an adequacy decision where the European Commission deem the territory to provide an equivalent level of data protection.
10. Data Retention
We will only retain your personal data for as long as necessary to fulfill the purposes for which we collected it, including to satisfy any legal, accounting, or reporting obligations. Specific retention periods depend on the nature of the data and the context in which it was collected. This includes any audio recordings or transcripts from the AI voice-enabled reservation system. When we no longer need to process your personal data, we will either delete or anonymize it.
11. Data Security
We implement appropriate technical and organizational measures to protect your personal data from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. These measures may include (but are not limited to) encryption, firewalls, secure servers, and access controls. While we strive to protect your personal data, the transmission of data over the internet or by voice technologies cannot be guaranteed to be completely secure.
12. Your Data Protection Rights
Under certain circumstances, you have the following data protection rights:
Right to Access: Request a copy of the personal data we hold about you.
Right to Rectification: Request correction of any incomplete or inaccurate data we hold about you.
Right to Erasure (“Right to be Forgotten”): Ask us to delete or remove personal data where there is no good reason for us to continue processing it.
Right to Restrict Processing: Request that we suspend the processing of your personal data in certain scenarios.
Right to Data Portability: Receive a copy of your personal data in a structured, commonly used, and machine-readable format, and transfer it to another data controller.
Right to Object: Object to processing of your personal data where we are relying on legitimate interests and there is something about your situation that makes you want to object on this ground.
Right to Withdraw Consent: Where we rely on consent to process your personal data, you have the right to withdraw that consent at any time.
To exercise any of these rights, please use the contact details in Section 13. You also have the right to lodge a complaint with a supervisory authority. In the UK, this is the Information Commissioner’s Office (ICO). In the EEA, you can contact the data protection authority in your country of residence.
